A battle over a special election in San Benito may now be over. The fight began last year when the former president of the city’s Economic Development Corporation filed a lawsuit challenging a special city charter election. A judge ultimately ruled that the election was held improperly because city commissioners failed to give residents proper notice.

The 13th Court of Appeals overturned that decision, but the lawsuit was then appealed to the Texas Supreme Court. The high court recently upheld the appeals court ruling, giving the city the green light to implement changes to its charter.

An attorney representing San Benito said the Supreme Court decision validates the results of the election and the actions of city leaders.
