Cameron County Man Loses Final Death Row Appeal

A Brownsville man could soon face execution after losing an appeal in federal court.

The Cameron County District Attorney’s Office announced Friday that the U.S. Fifth Circuit Court of Appeals has ruled against John Allen Rubio. He was originally convicted and sentenced to death for killing his daughter and two step-children in 2003. That conviction was overturned, but another jury found him guilty of the same charges in 2010.

The decision by the Court of Appeals means a stay on his execution could soon be lifted, allowing the state to carry out the sentence.
