A federal district judge says a Texas law banning state investments in companies boycotting the oil and gas industry is unconstitutional. Lawmakers passed the law in 2021 to discourage divestment from fossil fuel companies in the interests of climate concerns.
The law requires the state comptroller to make a list of companies that were to be excluded from state investments. The judge ruled on Wednesday that the law violates such companies’ constitutional rights to free speech and due process.
