A bill that will empower the attorney general’s office to prosecute election-related crimes is on its way to Governor Greg Abbott’s desk.

The Texas House on Tuesday passed Senate Bill 12 by an 85-54 vote. In 2021, the Court of Criminal Appeals ruled that the attorney general’s office couldn’t prosecute voter fraud and other election crimes without an invitation from local prosecutors.

Opponents of the bill say it may violate the separation of powers clause in the Texas Constitution. A proposal to put the bill before voters as a constitutional amendment didn’t get enough votes.
