Secretary of State Jane Nelson is opposing a Republican lawsuit that aims to close the state’s primary elections.

Texas Republicans sued Nelson in federal court in September, asking the court to close the primaries, which would limit voting to in the Republican primary to registered Republicans.

Nelson’s legal filings say the decision to close the primaries should be made by lawmakers, not the courts. Nelson took issue with her fellow Republican, Attorney General Ken Paxton, who agrees with the Texas Republican Party in the matter.
