The U.S. Supreme Court has reportedly denied a Brownsville man’s attempt to avoid execution. The high court refused the appeal of 45-year-old John Allen Rubio Monday.
Rubio was convicted of killing his two-month-old daughter and two stepchildren and sentenced to death in 2003. Rubio was retried after that verdict was overturned, but he was again convicted and sentenced to death in 2010.
Cameron County D.A. Luis Saenz said Monday that Rubio is likely to make additional appeals, but said his office plans to seek an execution warrant and execution date as soon as possible.
