A judge is granting the city’s motion to dismiss a lawsuit by Southwest Airlines over gate assignments at a future San Antonio airport terminal.

The Dallas-based carrier had sued the city and Aviation Director Jesus Saenz, claiming Southwest had been excluded from Terminal C for low scores on certain criteria.

The judge tossed out the lawsuit on Friday, ruling that the airline hadn’t presented a strong enough claim to proceed with the litigation.
