A South Texas group is evaluating a decision that could end their lawsuit over access to Boca Chica Beach during SpaceX launches.
The Texas Supreme Court decided last week that a judge correctly dismissed the lawsuit by Save RGV, ruling that private parties can’t sue to ensure and enforce public beach access.
The group originally filed suit against Cameron County, the Texas General Land Office and the agency’s commissioner in 2021. They argued that the repeated closures of Boca Chica Beach and State Highway Four violated an amendment to the state constitution that grants the public permanent access and use of Texas beaches. Attorneys are reviewing the decision and considering the next steps in the case.
