The Texas Court of Criminal Appeals is denying Otis McKane’s appeal of his death sentence. McKane shot and killed San Antonio police detective Benjamin Marconi in 2016.

Prosecutors say McKane ambushed Marconi, who was sitting in his patrol car outside police headquarters. McKane’s attorneys claimed he was denied a fair trial, but the court upheld both the conviction and the death sentence. McKane’s execution hasn’t yet been scheduled.
