A South Texas man who was deported and then returned to the U.S. has been released from federal custody.

Thirty-year-old Jose Contreras Diaz was brought to the United States as a child and was allowed to remain in the U.S. as part of the Deferred Action for Childhood Arrivals program. He was arrested earlier this year and deported to Honduras, but was brought back late last month after a ruling in a similar case. He was taken into custody as soon as he landed in Harlingen and held at a Port Isabel facility for about a week.

The Department of Homeland Security says it does not recognize DACA as a legal status and that Contreras Diaz could still be deported.
